General Terms and Conditions for Consumers in the European Economic Area
Version: 1.0 Last updated: August 20, 2026 Provider: Silestis Labs UG (haftungsbeschränkt), Munich, Germany
Welcome to Silestis! We provide technology that can convert audio and video recordings into text using AI models and can then further process that text. Depending on the plan, this includes transcription, translation, summarization, semantic search, chat over transcripts, export functions and other supporting functions. These General Terms and Conditions (these “Terms”) govern your personal use as a consumer of Silestis, our website, our web application, our browser extension and the other software, service and AI functions offered by us (together, “Silestis”).
If you use Silestis for commercial purposes, for example to process content for your company, to integrate it into your own products or to make it available to third parties, these consumer terms do not apply, or apply only to the extent we expressly confirm this. We provide separate terms for such use upon request.
Who we are and how to reach us. Silestis is provided by Silestis Labs UG (haftungsbeschränkt), registered in the commercial register of the Local Court of Munich under HRB 309539, VAT identification number DE460212346 (“Silestis Labs”, “we” or “us”). You can reach us by email at hello@silestis.com. You may also use this email address for data protection inquiries, accessibility notices and reports of unlawful content, unless a more specific form is provided on our website.
The most important points upfront. Before you read these Terms, you should know these 3 points:
-
As between you and Silestis Labs, you retain all rights to your uploaded content and to the results that Silestis generates for you, to the extent such rights legally arise and are held by us. Please note, however, that transcripts, translations, summaries, chat responses and other AI results may be inaccurate. Check important information before you use it or share it.
-
You must ensure that you have the required rights, permissions and consents before you upload, access, transcribe, share or further process audio, video, text or other content with Silestis. This applies in particular if recordings contain voices, personal data, copyright-protected content or content from third-party platforms.
-
You may not use Silestis to create, process or share unlawful content, infringe third-party rights, circumvent technical protection measures or misuse our service. Our Acceptable Use Policy also applies.
Contract. We recommend that you read these Terms, our Acceptable Use Policy and our withdrawal notice carefully. By clicking “I agree” or confirming a comparable button or checkbox when creating a Silestis account, making a booking or using Silestis, you agree to these Terms and our Acceptable Use Policy. This creates a binding contract between you and Silestis Labs.
- Access to Silestis
Age requirements. You must be at least 16 years old to use Silestis independently. If you are younger, or if consent is required under the law of your country of residence, you may use Silestis only with the consent of your parents or legal guardians. We may delete or suspend accounts if these requirements are not met.
Silestis account. To use Silestis, you need an account. You must provide complete and accurate information, in particular a valid email address, and keep your information up to date. Your account is intended for your personal use. You may not share your access credentials with other persons, sell, rent out or transfer your account, or create multiple accounts in order to circumvent plan limits, credits, suspensions or other restrictions.
Security of your account. You are responsible for keeping your access credentials confidential. If you notice any unauthorized or suspicious use of your account, please inform us without undue delay at hello@silestis.com.
Acceptance of registrations and orders. We may reject registrations and orders if there is an objective reason to do so, for example a justified suspicion of misuse, false information, circumvention of plan limits or previous serious breaches of these Terms or our Acceptable Use Policy.
- Paid Plans, Credits and Payment
Prices and plans. Silestis may be used free of charge or for a fee. The available plans, in particular Free, Go, Pro and Max, as well as the respective included functions, monthly credit allowances, storage limits, model options and prices, are set out in the plan overview shown to you before conclusion of the contract. All consumer prices include the applicable value added tax.
Credit units. Certain functions are billed using credit units. One minute of audio or video content may consume different numbers of credits depending on the selected AI model. The applicable factor will be shown to you in the plan overview, in the service or before processing starts. Credits from a monthly plan apply to the respective monthly billing period and are not carried over to later periods, provided that the service was made available in accordance with the contract during that period.
Credit add-ons. Where available, you may purchase additional credits as an add-on. Add-on credits become usable in your account after they are made available. For add-on credits that have not yet been used, your statutory rights apply, in particular your right of withdrawal, where applicable. Add-on credits that have already been used may be taken into account proportionately in the event of an effective withdrawal.
Order process. To book a paid plan, you must create an account, select the desired plan, review your order details, accept these Terms and submit your order using a clearly labelled button such as “Order now with obligation to pay” or equivalent wording. Before submitting, you can review and correct your information. The paid plan becomes available once your order has been confirmed by us and payment has been processed successfully.
Contract confirmation. After your order, you will receive a confirmation by email to the address linked to your account. The confirmation contains the essential contract information as well as these Terms, the withdrawal notice and, where required, the model withdrawal form. We recommend that you save these documents for your records.
Payment. Payment is processed through our payment service provider Stripe Payments Europe Ltd. You must provide complete and accurate payment and billing information and use a permitted payment method. For ongoing subscriptions, your payment method will be charged at the beginning of each billing period until you cancel or the contract otherwise ends.
Monthly subscription and annual option. A monthly subscription renews monthly until it is cancelled. An annual option may have a minimum term of twelve months but, where stated as such in the plan overview, is billed monthly. To the extent clearly stated before conclusion of the contract and permitted under the consumer law applicable to you, an annual option automatically renews after the end of the respective term for a further term of twelve months if it is not cancelled in time. If the mandatory consumer law applicable to you does not permit such automatic renewal, the legally permissible renewal or cancellation rule applies instead, in particular renewal for an indefinite period with the possibility of cancellation within the legally prescribed period.
Failed payment. If a payment for a paid plan or a credit add-on cannot be completed, the paid functions, additional credits, higher limits or other benefits of that plan may be unavailable in whole or in part until the payment has been successfully made. During this time, we may limit your access to the free plan or to the last paid functions. Your statutory rights remain unaffected.
Cancellation of paid plans. You may cancel your paid plan at any time through the account settings or through the cancellation function on our website. The cancellation takes effect at the end of the current billing period, unless there is a statutory or contractual right to earlier termination. Until then, you retain access to the paid functions.
Price changes. We may change prices for future billing periods, for example due to changed costs for AI models, infrastructure, taxes, regulatory requirements or material expansions of the scope of services. Price changes do not apply retroactively and do not apply during a billing period that has already started. We will inform you at least 30 days in advance by email or in the service. If a price change requires express consent, we will obtain it. If you do not agree, you may cancel the affected plan before the change takes effect.
- Use of Silestis
Silestis. We and our licensors retain all rights to Silestis, including the web application, the browser extension, user interfaces, trademarks, logos, software, system logic, documentation and other technical components. We grant you, for the term of this contract, a personal, non-exclusive, non-transferable right to use Silestis within the scope of these Terms and your plan.
Scope of services. Silestis may include, in particular, the following functions: automated transcription of audio and video recordings, timestamps, speaker recognition, translation, summaries, chapter overviews, flashcards, task lists, chat over transcripts, semantic search, export to formats such as TXT, PDF, DOCX, SRT, VTT or JSON, and a browser extension to support the capturing or transfer of content. Not every function is included in every plan.
AI models and subprocessors. We use AI models and technical infrastructure from third-party providers, in particular model, cloud, storage, analytics and payment providers. We describe the relevant providers and subprocessors in our privacy policy or subprocessor list. We remain your contracting party and are responsible for providing Silestis in accordance with the contract.
Restrictions. When using Silestis, you may not:
(a) breach applicable law, including applicable export control and sanctions rules, these Terms or our Acceptable Use Policy;
(b) upload, access, transcribe, process or share content if you do not have the required rights, consents or legal bases for doing so;
(c) infringe third-party rights, in particular copyrights, personality rights, data protection rights, rights in one’s own spoken words or rights in voices and recordings;
(d) upload, access, transcribe, process or share personal data of children or minors if you lack the required consent, permission or legal basis for doing so, or enable minors to use Silestis without required consent;
(e) circumvent technical protection measures, access controls, DRM systems, paywalls, platform restrictions, plan limits or security mechanisms;
(f) reverse engineer, decompile, automatically scrape or examine Silestis or its underlying models, systems or interfaces, including with the help of output or modified output, unless this is mandatorily permitted by law;
(g) disrupt or overload the service, circumvent security mechanisms, conduct unauthorized security, load, vulnerability or penetration tests, or use malicious code, spam, phishing or other abusive content;
(h) extract, copy, store in bulk, scrape or further use content, data or results from Silestis other than as permitted through the intended functions of Silestis;
(i) sell, rent out, transfer or make available to third parties your account, access credentials, API access or credits;
(j) integrate Silestis into your own products or services without our express consent, resell it as your own service or make it available to third parties as technical infrastructure;
(k) use audio, voices, transcripts or AI output to impersonate another person, imitate or clone voices without required consent, or support fraud, deception, disinformation, harassment, discrimination, hate, unlawful surveillance or other unlawful purposes; or
(l) present AI output as having been created exclusively by a human if this would be misleading under the circumstances or if there is a statutory labelling obligation.
Usage limits. Depending on your plan, your use may be subject to credit limits, storage limits, rate limits, model restrictions or other fair usage limits. If you reach a limit, the affected function may be restricted until the next billing period, until additional credits are purchased or until an upgrade is made.
Browser extension and source platforms. If you use our browser extension or URL functions, you are responsible for ensuring that you may lawfully use the content from the respective third-party platform. Silestis is not intended to circumvent technical protection measures or platform restrictions. Access credentials for third-party platforms should not be transmitted to us unless the function expressly provides otherwise.
Shared folders and sharing links. Silestis may include functions that allow you to share transcripts, folders or content with invited persons or through secret sharing links. Persons with access to such a link can view the shared content, even if the link is passed on. We do not control to whom you pass on a sharing link or who subsequently receives it. You are responsible for sharing only content that you are permitted to share and wish to share.
Third-party services. If you connect third-party services with Silestis or use content from third-party platforms, the terms of those third-party providers also apply. Third-party services are not part of Silestis unless they are expressly offered as a component of our service. We are not responsible for their availability, security, content, decisions or data processing, unless the respective issue is based on our own breach of duty.
Updates. We may provide updates that are necessary to keep Silestis secure, functional, compatible or legally compliant. If an update must be installed or activated by you, we will inform you of the essential steps and the consequences of not installing it. We may also provide non-mandatory updates, improvements and new functions.
Availability. We provide Silestis with professional care and make efforts to ensure reasonable availability. We do not guarantee a specific availability rate. Maintenance, security measures, disruptions at AI model providers, cloud providers, payment services, internet infrastructure or events outside our reasonable control may temporarily impair use. Your statutory rights in the event of non-conforming performance remain unaffected.
- Your Content and Your Results
Your content. You may enter or upload audio, video, text, prompts, URLs, documents, metadata and other content into Silestis (“Input”). The results that Silestis generates from this, in particular transcripts, translations, summaries, chapters, flashcards, task lists, chat responses, search results and exports, are called “Output”. Input and Output together are called “Your Content”.
Rights to Input and Output. As between you and Silestis Labs UG (haftungsbeschränkt), you retain all rights to your Input. To the extent rights arise in the Output and to the extent we can validly transfer such rights, we transfer to you the rights in the Output that are held by us. We do not claim any exploitation rights of our own in your Output, except to the extent required to provide, secure, maintain and troubleshoot the service, enforce these Terms or fulfil legal obligations.
Similar results. AI systems may generate similar or identical results for different users, in particular where the Input is similar. We cannot guarantee that your Output is unique. Similar results of other users are not deemed to be your Output.
Processing licence. You grant us a non-exclusive, worldwide, royalty-free licence, limited to the required duration, to host, copy, technically convert, segment, transmit to subprocessors, analyse and process your Input and Output to the extent required to provide, maintain, secure and troubleshoot Silestis, fulfil your requests, enable your exports, enforce our rights or fulfil legal obligations.
No model training without consent. We do not use your Input and Output to train our own or third-party AI models unless you have expressly consented to this or a legal obligation permits or requires a specific processing activity. We use subprocessors for AI processing only if the use of your content for model training is excluded or takes place only with your express consent. Details can be found in our privacy policy and subprocessor list.
Feedback. If you give us feedback, such as reviews, error reports or suggestions for improvement, we may use that feedback to improve Silestis. If feedback contains specific content or personal data, we process it only in accordance with our privacy policy.
Responsibility for Your Content. You are responsible for your Input and for the use of your Output. You warrant that you have all required rights, licences, consents or other legal bases to process content in Silestis. This applies in particular to recordings of conversations, meetings, interviews, lectures, telephone calls, videos, copyright-protected works, voices of identifiable persons and personal data of third parties.
Accuracy of Output. Silestis is based on AI models and automated processing. Output may be wrong, incomplete, misleading, biased, inaccurate or fabricated. Transcripts may incorrectly recognize words, proper names or speakers; translations may lose nuances; summaries may omit information; chat responses may be inaccurate. Silestis is not a reliable sole source of truth and is not a substitute for legal, medical, tax, financial or other professional advice. Check Output before you use it, publish it or pass it on to third parties.
Third-party content. If Silestis displays, links to or processes content from third-party sources, that third-party content remains the property or responsibility of the respective rights holders. These Terms do not give you any rights to third-party content, except to the extent you independently possess or legally obtain such rights.
Storage and deletion of original audio. Submitted original audio or video files are deleted after successful completion of processing, unless they continue to be needed for a function selected by you, such as playback, temporary troubleshooting, export or legal obligations. If your plan includes a playback or storage function, a playable copy may be stored until you delete it, delete your account or the contract ends. Transcripts and AI artifacts generated from them remain stored in your account until you delete them or your account is deleted, unless statutory retention obligations prevent this.
Trash and final deletion. If Silestis offers a trash or restore function, content deleted by you will initially be moved to the trash and kept there for a limited period for restoration. Content in the trash will be automatically and permanently deleted no later than after 30 days, unless you restore it or permanently delete it beforehand. After final deletion, the content is no longer available through your account. Technical backup copies may remain in backups for a limited period and will be deleted or overwritten there according to our usual backup cycles, unless legal obligations, security reasons or the enforcement of rights require longer retention.
Data export. You can download your stored content during the term of the contract through the export functions offered in the service in common formats, to the extent the respective function and format are available.
- Prohibited Content, Notices and Moderation
Prohibited content. You may not use Silestis to create, process, store or share content that is unlawful, infringes third-party rights or is prohibited under our Acceptable Use Policy. This includes in particular content that infringes copyrights, disregards personality rights or data protection rights, or promotes or facilitates hate, violence, sexualized violence against children, fraud, malware, phishing, stalking, harassment, non-consensual intimate content, terrorism, self-harm or other serious harm.
Moderation. We do not generally monitor private content and do not manually review your content without reason. However, we may review content, accounts or uses where this is necessary to protect these Terms, our Acceptable Use Policy, legal obligations, the security of Silestis or third-party rights. We may remove content, restrict access, deactivate sharing links, block functions, temporarily suspend accounts or terminate contracts if there is a breach or a serious risk. Where possible and legally permissible, we will inform you beforehand or at the latest when taking the measure and state the main reasons. We act carefully, objectively and proportionately and take into account the rights and legitimate interests of the persons concerned.
Reporting unlawful content. If you find content on Silestis that you consider unlawful or that breaches these Terms or our Acceptable Use Policy, you may notify us at hello@silestis.com or through a reporting form provided by us. Please state as precisely as possible: which content you are reporting, where we can find it (for example URL, share link or resource ID), why you consider it unlawful or impermissible, which country or legal system is affected, and how we can reach you. Please also confirm that your report is correct and complete to the best of your knowledge. For reports concerning depictions of sexualized violence against children or comparable serious criminal offences, you do not have to provide your name and email address to the extent the law so provides.
Handling of reports. We review reports carefully, objectively and without undue delay. If you have provided us with an electronic contact address, we will acknowledge receipt and inform you of our decision to the extent legally permissible and practically possible. If we use automated means to process or decide on a report, we will inform you of this to the extent required by applicable law.
Statement of reasons for measures. If, due to unlawful content, a breach of these Terms or a breach of our Acceptable Use Policy, we remove content, restrict access, deactivate sharing links, block functions, or suspend or terminate an account, we will inform the affected user to the extent we have electronic contact details and to the extent this is legally permissible. The notice will contain the main reasons for the measure, in particular the type of measure, the relevant facts, whether the decision was based on a report or our own review, whether automated means were materially involved, the legal or contractual basis and the available review options.
Misuse of the reporting procedure. Abusive, manifestly unfounded or repeatedly submitted reports in large numbers may result in our restricting the use of the reporting procedure to the extent permitted by law. Likewise, after prior warning, to the extent a warning is appropriate and legally possible, we may restrict accounts or functions if users repeatedly provide manifestly unlawful content or repeatedly breach these Terms or our Acceptable Use Policy.
Review of measures. If you believe that we have mistakenly restricted, removed, blocked or terminated content, functions or your account, you may contact us at hello@silestis.com. We will review your objection and inform you of the outcome. To the extent an internal complaint-handling system or another special review option is required under the Digital Services Act, we will provide this in accordance with the statutory requirements.
DSA contact point. To the extent the Digital Services Act applies to Silestis, we provide a DSA information page on our website with the currently applicable contact points and information. Users and authorities may contact us regarding DSA matters at hello@silestis.com as long as no more specific contact point or form is specified on this DSA information page. The DSA information page contains in particular information on contact points for users and authorities, the supported communication languages, the procedure for reporting unlawful content, the basic principles of our moderation and any transparency information, to the extent such information is legally required or provided voluntarily.
- Warranty and Statutory Rights
Our performance. We provide Silestis with professional care and make efforts to operate a secure, functional and contract-compliant environment. If you use Silestis in accordance with these Terms, the service should correspond in material respects to the documentation, plan description and public product description provided by us.
Statutory defect rights. In addition to this contractual commitment, you have the mandatory statutory rights for digital services and digital content. If Silestis is not provided in conformity with the contract, you may in particular require us to bring the service into conformity with the contract. If this does not succeed, is impossible, is refused or does not occur without significant inconvenience, you may have further rights under applicable law, such as price reduction, reimbursement, termination of the contract or damages.
AI Output and defect. The notice that AI Output may be inaccurate does not exclude your statutory rights. Whether specific Output is defective depends on what you may reasonably expect based on the product description, plan, price, state of the art and nature of the function.
Your warranties. You warrant that you are entitled to accept these Terms, use Silestis under these Terms and process the content you provide. You also warrant that your use does not breach applicable law, third-party rights or our Acceptable Use Policy.
- Liability
Care and statutory rights. We provide Silestis with professional care and make efforts to provide a secure, reliable and contract-compliant environment. Nothing in these Terms limits your mandatory statutory rights, in particular your rights if Silestis is not provided in conformity with the contract or if statutory requirements for digital content, digital services or other services are not met.
Unlimited liability. Nothing in these Terms excludes or limits our liability to the extent an exclusion or limitation is not permitted under applicable law. This applies in particular to liability for death or personal injury caused by our act or omission, fraud or fraudulent misrepresentation, intentional or grossly negligent conduct, expressly assumed guarantees, product liability, data protection liability, mandatory statutory consumer rights for digital content, digital services or services, and any other liability that may not be excluded or limited under applicable law.
Foreseeable damage and essential duties. To the extent permitted by applicable law and where there is no unlimited liability under the preceding paragraph, we are liable for damage caused by a breach of essential contractual duties only for the foreseeable damage typical for this type of contract at the time the contract was concluded. Essential contractual duties are duties whose fulfilment is what makes the proper use of Silestis possible in the first place and on whose compliance you may regularly rely. For simple negligence outside such essential contractual duties, we are liable only to the extent mandatorily required by applicable law.
Excluded damage. To the extent permitted by applicable law and where there is no unlimited liability or liability for breach of essential contractual duties, we are not liable for indirect damage, consequential damage, lost profit, lost revenue, loss of business opportunities, loss of goodwill, business interruptions, damage arising from business or professional use, or for damage arising from your use, publication or sharing with third parties of Output without appropriate review. These Terms are intended for personal use by consumers and do not cover business damage.
Damage not caused by us. To the extent we have acted with professional care, we are not liable for damage that was not caused by a breach of duty by us, was not foreseeable or was based exclusively on events outside our reasonable control. This may include in particular natural events, war, terrorist attacks, labour disputes, official orders, large-scale internet disruptions, attacks on upstream infrastructure or failures of services that are not part of our own performance obligation and that we cannot prevent despite reasonable care. Your mandatory consumer rights remain unaffected.
Data loss. We use appropriate technical and organizational measures to protect Your Content. Since no system is completely fail-safe, we recommend that you regularly back up important content using the export functions. If content is lost due to a breach of duty for which we are responsible, our liability is governed by the preceding rules and your mandatory statutory rights. To the extent permitted by applicable law, we are not liable for data loss that was not caused by our breach of duty or that could have been avoided through reasonable backup by you.
Indemnification for third-party claims. To the extent permitted by applicable law, you indemnify us, our affiliates, service providers, corporate bodies, employees and agents against third-party claims and reimburse us for reasonable and necessary costs, including reasonable legal defence costs, to the extent the claim arises because you culpably (a) breach these Terms or our Acceptable Use Policy, (b) upload, process, share or publish content with Silestis without required rights, consents or legal bases, (c) use Output unlawfully or in a rights-infringing manner, or (d) make Silestis available for impermissible business purposes or to third parties. This indemnification does not apply to the extent the claim was caused by our own breach of duty or is manifestly unfounded.
Procedure for third-party claims. If such a claim is asserted against us, we will inform you, to the extent legally permissible, within a reasonably prompt time and give you a fair opportunity to support us in the defence. We will not enter into any settlement that imposes a payment obligation, an acknowledgement of debt or another material obligation on you without your prior consent, to the extent this is legally and practically possible.
- Withdrawal
Right of withdrawal. If you book a paid plan as a consumer, you have a statutory right of withdrawal, rescission or comparable cancellation right only to the extent such a right is granted to you under the mandatory consumer law applicable to you. If you have a statutory 14-day right of withdrawal, you may withdraw from this contract within 14 days from conclusion of the contract without giving reasons. This applies in particular to consumers whose habitual residence is in the European Union or the European Economic Area. In other countries, rights of withdrawal, rescission, cancellation or reimbursement apply only to the extent they exist under the mandatory consumer law applicable there. Details are provided in our withdrawal notice, which is made available to you before conclusion of the contract and with the contract confirmation.
Exercise. To exercise the right of withdrawal, you must clearly notify us within the withdrawal period that you wish to withdraw from the contract. You may use the account settings, the model withdrawal form, an email to hello@silestis.com or another contact channel provided by us for this purpose.
Early start of performance. If you want us to begin providing a paid digital service before expiry of the withdrawal period, we may require your express consent or request for this. If you then validly withdraw, we may request proportionate remuneration for the performance provided up to the time of withdrawal, but only to the extent permitted by applicable law and only if we have obtained the required information and consents for this. For ongoing subscriptions, the service is not treated as fully performed merely because you first use it. It is generally treated as provided over the relevant billing period.
Consequences of withdrawal. If you validly withdraw, we will reimburse you for all payments that we have received from you without undue delay and no later than within 14 days from the day on which your declaration of withdrawal is received by us. We will use the same payment method as for the original payment unless you agree otherwise. We do not charge any fees for the reimbursement. To the extent you have already used services and proportionate remuneration or statutory compensation for value is owed under applicable law, we may deduct that amount from the reimbursement amount.
Credit add-ons. A right of withdrawal may also exist for credit add-ons. If you use or consume add-on credits before withdrawal at your express request, the reimbursement may be reduced proportionately according to the ratio of consumed to purchased add-on credits, to the extent this is permitted by applicable law and we have obtained the required information and consents for this. Your mandatory consumer rights remain unaffected.
- Data Export, Switching and Termination
Switching and export. You may export your content stored in Silestis through the export functions offered in the service. Depending on the function and plan, this may include transcripts, translations, summaries, chapters, flashcards, chat content, metadata and other content generated by you. Our software, models, system logic, proprietary technologies, internal security data and content that does not belong to you cannot be exported.
Switching request. If you need data that is not available through the self-service export function, you may contact us at hello@silestis.com. We support export to a reasonable, technically possible and legally owed extent.
No compatibility guarantee. We do not guarantee that exported data is compatible with the systems, formats, workflows or services of other providers. However, we of course provide common and machine-readable export formats.
Term. These Terms apply for as long as you use Silestis or have an account with us.
Suspension or termination by us. We may suspend your account or access to Silestis in whole or in part, or terminate the contract, if you breach these Terms or our Acceptable Use Policy, fail to pay due fees, a legal obligation requires this, or your use creates an actual risk for us, other users, third parties or the service. Where possible, we will inform you in advance and give you an opportunity to remedy the issue. This does not apply if immediate action is required, the breach cannot be remedied or prior information is not legally or from a security perspective reasonable.
Termination by you. You may delete your account or terminate this contract by using the corresponding function in your account, the cancellation function on our website or a contact channel provided by us. For paid plans, the cancellation periods and terms from Section 2 apply.
Consequences of termination. When termination takes effect, your right to use Silestis ends. Please export Your Content before account deletion or before the end of your access. After account deletion, we delete Your Content unless statutory retention obligations, billing purposes, security purposes or defence against claims require further storage. Payment obligations that have already arisen and rights that by their nature are intended to continue remain unaffected by termination.
- Data Protection
Privacy policy. We process personal data in accordance with our privacy policy and the applicable data protection laws. The privacy policy explains in particular which data we process, for which purposes and on which legal basis this takes place, which subprocessors we use, whether data is transferred to third countries, how long data is stored and which rights you have.
Role of Silestis Labs UG (haftungsbeschränkt). To the extent we process personal data to provide Silestis, manage accounts, process payments, ensure security, communicate, prevent misuse and perform the contract, we act as controller. To the extent you process personal data of third parties with Silestis, such as voices or conversation content of other persons, you may be responsible for this processing yourself. You must then ensure that you have a sufficient legal basis and properly inform the affected persons, to the extent required.
Data protection contact. For data protection inquiries, you may contact us at hello@silestis.com. Further information on exercising your data protection rights can be found in our privacy policy.
Cookies and similar technologies. To the extent we use non-essential cookies, tracking technologies or access to information on your end device, we obtain separate consent for this to the extent legally required.
- Changes to these Terms and to the Service
Changes to these Terms. We may update these Terms and our Acceptable Use Policy from time to time, for example due to new functions, changed technical processes, changed cost structures, statutory requirements, security requirements or regulatory requirements.
Notice. We will inform you of changes that may materially affect you at least 30 days before they take effect by email or in the service. The notice describes the change, the time it takes effect and your rights.
Your choice. If you do not wish to agree to a change, you may terminate the affected contract before it takes effect and do not have to continue using Silestis after the change takes effect. To the extent your express consent is required under applicable law, the change will become part of the contract only if you consent.
Non-adverse changes. We may make clarifications, editorial corrections, updates to contact details, new voluntary functions or changes that do not reduce your rights and do not expand your duties without separate consent.
Changes to the service. We may change, replace or discontinue Silestis and individual functions if there is an objective reason to do so, for example security, technical development, low usage, changes to third-party offerings, regulatory requirements or improvement of the service, and the change is made without additional cost to you. If a change materially adversely affects your use, we will inform you appropriately in advance by email or on another durable medium about the content, timing and your rights. In this case, you may terminate the affected contract free of charge, unless the impairment is only insignificant or we enable you to continue using the previous version without additional cost. Your statutory rights remain unaffected.
- Applicable Law and Dispute Resolution
Applicable law. This contract is governed by the law of the Republic of Ireland, unless mandatory consumer protection rules of your country of habitual residence take precedence. Nothing in these Terms limits your rights as a consumer to rely on such mandatory provisions.
Courts. You may bring claims against us before the courts of your country of residence or, where permissible, before the courts at our registered office. We may generally bring claims against you as a consumer only before the courts of your country of residence, unless mandatory law permits otherwise.
Amicable resolution. If you have questions, complaints or feedback about these Terms or Silestis, please contact us at hello@silestis.com. We make efforts to review concerns fairly and promptly.
Consumer dispute resolution. We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board, unless mandatory law requires otherwise. Your statutory rights to bring matters before courts or competent authorities remain unaffected.
- General
Your mandatory rights. You retain all mandatory rights to which you are entitled under the law of your country of residence, under EU law or under other mandatory consumer law. These Terms are not intended to exclude or limit such rights.
Usage data and statistics. We may create and use aggregated or anonymized data and statistics about the use, performance and security of Silestis in order to operate, protect and improve the service, develop new functions, analyse costs and performance, and prevent misuse. Such aggregated or anonymized data is not personal data to the extent it is not possible to draw conclusions about an identified or identifiable person.
Assignment. You may not transfer rights and duties under these Terms without our consent. We may transfer rights and duties under these Terms to an affiliate or legal successor to the extent this does not materially impair your consumer rights.
No partnership. These Terms do not create any company, partnership, employment, commercial agency, franchise or comparable relationship between you and us.
No third-party rights. These Terms do not create any rights in favour of third parties unless expressly provided otherwise or mandatory law provides otherwise.
No waiver. If we do not exercise a right under these Terms immediately, we do not thereby waive that right.
Entire agreement. These Terms, the Acceptable Use Policy, the withdrawal notice and the plan and order information shown at the time of conclusion of the contract form the agreement between you and us regarding the use of Silestis. Privacy information, subprocessor lists, Accessibility Statement, open-source notices and DSA information supplement this agreement as informational documents, unless they are expressly part of the contract.
Invalidity of individual provisions. If a provision of these Terms is or becomes invalid, the rest of the contract remains effective. The statutory rule applies in place of the invalid provision.
Language. These Terms may be provided in German and English. In the event of contradictions between language versions, the version more favourable to you as a consumer applies, unless mandatory law provides otherwise.
Accessibility. You may send us accessibility notices concerning Silestis at hello@silestis.com. Further information on the current accessibility status, including any classification as a microenterprise and voluntary orientation towards WCAG/EN 301 549, is provided in our Accessibility Statement.

Browser extension. If you use a browser extension from Silestis, you may use it only on supported browsers and only within the scope of these Terms. The extension may not be used to circumvent technical protection measures, extract content without authorization or breach the terms of third-party platforms.

Compatibility. We make efforts to state the supported browsers, operating systems and platforms in an up-to-date manner. We do not guarantee that Silestis will remain permanently compatible with every device, browser, operating system or third-party platform. If a change in compatibility significantly impairs your use, your rights under Section 11 and your statutory rights apply.

Appendix 2 - Country-Specific and Regional Consumer Notices
Germany. If your habitual residence is in Germany, you have the statutory defect rights for digital products. Your right to extraordinary termination for good cause remains unaffected. For paid subscriptions concluded online, we provide a cancellation function on our website to the extent legally required.
European Union and European Economic Area. If your habitual residence is in the European Union or the European Economic Area, you benefit from the mandatory consumer rights of the state in which you have your habitual residence. These Terms do not limit those rights. This applies in particular to statutory rights in the event of non-conforming provision of digital content or digital services and to a right of withdrawal, to the extent you have such a right under applicable law.
Switzerland and United Kingdom. If your habitual residence is in Switzerland or the United Kingdom, the mandatory consumer protection rights there also apply, to the extent they cannot be excluded or limited under applicable law.
United States of America. If your habitual residence is in the United States of America, these Terms apply to the extent Silestis is available there. We grant you a statutory 14-day right of withdrawal like in the European Union or the European Economic Area only if the mandatory law applicable to you requires this or if we expressly promise this in the order process. Mandatory consumer rights under the law of your state, in particular regarding automatic renewals, cancellation options, refunds or unfair business practices, remain unaffected.
Other countries. If your habitual residence is in another country, these Terms also apply to the extent Silestis is available there. Mandatory consumer rights of the country in which you have your habitual residence remain unaffected to the extent they cannot be excluded or limited under applicable law.
